As mentioned in session 3, there are some structural issues in the field of International Human Rights Law I would like you to reflect on:
– The sources of International Human Rights Law: differences with public international law.
– The subjects of international human rights: do non-state actors have human rights obligations?
– The territorial scope of human rights obligations: do states owe human rights obligations beyond their borders?
– The International Human Rights Law and domestic law: problems of applicability and incorporation.
For the essay, you may focus on one of the structural issues directly according to your general interest, or please choose one of the following topics:
Describe the history of the formation of the international law regime and human rights within it, and critically discuss the critiques of this history and its impact(s)
As a reminder, students must choose from the three theory topics generated by the instructor for essay 1 above. All topics are related to the subject matter covered in the first 4 sessions. You may rely upon additional research beyond the assigned readings. Essays should be a maximum of 1,500 words, excluding the list of references. Students submit an outline of the essay in week 4 (please use the link below), and then the final essay in week 5 (the link will be provided below). Students may rewrite the essay to improve their grade and resubmit in week 8.
Please Note: The outline submitted in Week 4 should include a short abstract (100-200 words), a list of your essay sub-headings with a brief statement of what will be in each section, and a list of references.
