High court rules against state in ’emergency room boarding’ case
For my first project, I will be doing an amicus brief of 4500 words. I will be writing about a case that happened/is still happening in New Hampshire over an individual being kept against their will in a hospital emergency room for weeks due to the lack of open beds in psychiatric facilities. The main issue at hand is that this individual did not have any rights at all as soon as they stepped into the hospital. This directly goes against Jane Doe versus the Department of Health and Human Services and highlights a deeper issue within the system that there is a huge lack of support given to those with mental and health disabilities. In the first part of my paper i want to talk about this as my amicus brief and then talk about how so many times in my field I hear two sides of mental health and disabilities. Sometimes I have to hear about how people are just lazy and the government shouldn’t be funding them. However, working with these people firsthand, is not as easy as “just going out and getting a job.” This topic has gotten so political that it is no longer a topic of helping people.
