At the end of 6 months F wanted more space and moved out of Ms apartment
M grabbed F in public shortly thereafter, blocked her path and grabbed her by the arm
M let go when F agreed to walk and talk with him

F told M that their relationship was over
F walked back with M to their once shared apartment
M and F had sexual intercourse
F claimed that she did not consent to the intercourse.
M claimed that he had every right to have intercourse with F and that her passive actions indicated implied consent
