This
assignment is in two parts.
First, answering the following question give a 3-4 page literature
review of the readings from Week 4. This week you will be answering the
following question What
role do the States play in the creation of legislation?” Instructions on
how to complete a literature review are here. While completing this
assignment I would like you to think more thoroughly about the following points
and ensure to answer them throughout your writing assignment. Please pay
particular attention to
1) What powers
do state legislatures have?
2) What role do
state legislatures play in the overall momentum of legislation?
3) What
role does federalism play in the legislation you have chosen to research?
The second component of this assignment will be your own original
research. Using the website openstates.org search for either your bill
specifically or use search terms that are related to your bill (please let me
know what search terms you used).
1) Review West
Virginia state laws and a piece of legislation that deals with your topic.
Explain the bill and how it relates to your research.
2) If you can
find information on who proposed the bill and why they did please note the
sponsors, co-sponsors, etc- identify if it was partisan or bi-partisan, how
many sponsors/co-sponsors. Local newspapers are going to be a great place for
this.
Explain how it is either similar or dissimilar to the
federal stance on the legislation by researching and relaying the pertinent
information from the state legislation vs the federal legislation. Also note it
may be completely different as states attempt to challenge federal legislation
often times throughout legislation.
The federal law to focus on is the Sex Offender Registration and Notification Act. When looking at West Virginia Laws please use the laws enacted to comply with the federal laws. I am attaching the previous authors attempt to complete this order to assist you with source material, but please take caution as the work was terrible. For the literature review, please only use the sources that have been provided and cite them extensively.
