Business Law Course project 1

Business Law I
Course Project
Part I
On February 27, 2019, American Legion et al v. American Humanist Assn. et al was argued before the United States Supreme Court. The case was decided on June 20, 2019. The case involves the 40 foot tall cross in Bladensburg, Maryland. Your tasks are to read the materials, discuss them, and apply legal concepts learned throughout the first several weeks of this semester.
READ
The complete case, a slip opinion*, can be found below. This is an 87 page document. Focus on pages 1-7. The remaining pages are details on the Court’s opinion, concurring and dissenting opinions. https://www.supremecourt.gov/opinions/18pdf/17-1717_4f14.pdf.

DISCUSS
Using the materials above, you will prepare a Power Point presentation to discuss and apply the concepts in this case to the ones you’ve learned over during this semester. You may use additional sources, if desired. Here are the parameters for the assignment:
Prepare a Power Point presentation as if you were giving a lecture.
Slide 1 is your title slide with your name and project title (Project #1-Bladensburg Cross Case).
Use 2-3 slides to explain the case. Include: Facts (substantive and procedural); Issue(s) presented; Rule (used to make the decision); Holding (what the Court decided); Analysis (why the Court decided what it did) Conclusion (what did the Court do; what happened procedurally). HINT: Each part must be clearly identified.
Use 1 slide to explain the liberal viewpoint and use 1 slide to explain the conservative viewpoint. This is where you would use the news articles from The New York Times and The National Review.
Use 1 slide each to discuss the following items. You will need to refer to the case and its commentary to complete these. Notice-these are concepts from each chapter we have discussed thus far (except Ch. 29):
Ethical considerations of this case. For full credit, discuss a theory or theories from our text.
Relevant common law or statutory laws that may help support or refute the outcome. For full credit, properly state case names or applicable statutes.
Constitutional provision(s) or applications that concern this case. Properly identify and discuss.
Other ways this case could have been resolved (mediation, arbitration, negotiation). HINT: Do not merely list them; instead, discuss. State why they would or would not work.
Based on the facts or outcome of the case, could there be any criminal acts that may relate to this? (Think about people’s reaction and response to this case…) Discuss them here.
Use 1-2 slides to critique the case. Answer three questions:
In considering the Establishment Clause of the First Amendment (see below), do you believe the Court made the right decision? Make sure your answer applies law to fact. This is not a subjective opinion question. Be objective in your response.
Based on your understanding of the case and of the Establishment Clause, why did the Court make the decision it did?
What is your opinion of this case? This is your time to express your thoughts in a subjective manner. Explain why you personally think the Court got it right or why the Court got it wrong.
The First Amendment states “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”
Use 1 slide to conclude your presentation with a summary. HINT: The critique is not your conclusion. Sum it all up effectively.
Use 1 slide for references. Use APA format. You can use http://www.citationmachine.net/apa/cite-a-website to assist you in doing it properly.
FORMAT
You will prepare this project as any other Power Point. The choice of design, use of animations, and font are entirely up to you. These are the items to provide and consider.
Include citations. When you refer to sources (either the ones given in the assignment or ones you find yourself), you should put the citation in the note portion of each slide. These are on the bottom of each page. ONLY put the citations in the notes portion of your presentation.
You need to be objective. In every slide, unless you are asked for your opinion, be objective in your response.
Make sure your responses apply fact to law. You are asked to apply concepts from Chapters 1, 2 and 4-7. An example is that for Chapter 3, you could look and see what law/test the Court refers to (and says doesn’t apply) that came from case law. Your explanations should be factual, using the laws discussed in your book and lectures. NOTE: You will apply a concept from every chapter.
The PowerPoint should be a synopsis. Use bullets; short points and excerpts. Do not write in an essay format. If you want to add additional content, add it to the note portion of the slide.
The slide counts are the minimum. If you want to do more, you may add more.
SUBMISSION
You will submit this using the Assignment tool, uploading your PowerPoint Presentation as an attachment. No other submission format will be accepted. To submit your project, click on the link or go to the Assessments tab at the top of your screen. You will need to find and click on “Course Project Part I.” In the subject line, write your name and “Course Project Part I.” It should appear as “First Name Last Name Course Project Part I.” You will be able to add the PowerPoint as an attachment. There is dialog below the text box that says, “Add Attachments.” Make sure the PowerPoint uploads.
Your assignment will be graded via a rubric.
Course Project I is worth 100 points.
DUE DATES
See your module, myCalendar, and the Course Schedule for your due dates.
To be successful, you should work on this each week as you complete the chapter modules.
*A slip opinion is the opinion that was published before its final draft was completed, which means there may be errors in grammar or format. This opinion has a syllabus of the Court with it. Slip opinions are the first version of the Court’s opinion. There are no official citations with this version of the opinion.
