The Federal Rules of Civil Procedure govern civil proceedings in the United States district courts. Their purpose is “to secure the just, speedy, and inexpensive determination of every action and proceeding” (Legal Information Institute, 2015, Rule 1). The Federal Rules of Evidence governs the admission of facts parties use to prove their civil and criminal cases in the U.S. federal court system.

Imagine that you are testifying as an expert at a hearing regarding a defendant’s competency to stand trial. The defense attorney asks you to offer an opinion regarding the defendant’s mental status at the time of the offense charged, an evaluation that you did not conduct. How should you proceed?
