Phillips was an inmate confined in an Arkansas prison. In June 2000, he was charged by the staff with carrying contraband (smoking products). Pending a hearing, he was transferred from general housing to an isolation area. In the isolation area, he was without:
the privileges of contact visits,
yard and gym access, and
chapel privileges.
Although the contraband charge was never acted on, Phillips was not returned to his original housing unit. Upset, he refused to return to his assigned housing area. He received disciplinary action, was found guilty, and lost, among other things, good time. He was released from isolation near the end of July. Phillips filed a Section 1983 action, claiming, in part, constitutional violations of his due process rights, specifically citing the atypical hardships necessitated by his placement in isolation. He argued that the Fourteenth Amendment prohibited violation of his liberty interests without due process of law.
