Regulatory Analysis – Electronic Visit Verification
Review the Proposed Text, Agency Background Document, and DPB Economic Impact Analysis for this stage:
https://townhall.virginia.gov/L/ViewStage.cfm?stageid=8364.
Write a 6-page response paper that addresses the following prompts. If you want, you can organize your writing in sections with subtitles corresponding to each bullet point.
● Summary: Summarize the proposed regulation. What is the purpose of this regulation? What requirements are being added and who would/would not be affected by them?
● Economic Impact: What economic impacts are identified in the EIA? Are there any other effects that you can think of that weren’t addressed in the EIA? Is there anything you agree or disagree with in the EIA?
● Controversy: If you scroll down to “Status” and look under “Comment Period” you will see that this stage received 1,101 comments. Scroll through and read some of them and identify some of the main issues that stand out to you. Briefly describe the main issues, and what economic and non-economic impact they have.
● Proposal: Suppose DMAS had approached you before crafting the regulatory changes, saying that although the CURES Act requires electronic visit verification, they want to implement the requirements in a way that would minimize the adverse impact on caregivers and the people who receive home-based services.
○ Suppose DMAS gives you a list of home healthcare agencies in the state (the organizations that hire and send caregivers) and organizations that represent people with disabilities (who receive home health care services, including by live-in caregivers.) You have independent funding to conduct a survey or run an experiment.
○ What recommendations would you make to DMAS that could address some of the issues raised by the comments?
○ What data would you collect to support your recommendations to DMAS?
