PART 1:
Torts Analysis
On December 10, 2019, John, 14 years of age and an eighth grader at Mayberry
Middle School in Mayberry, Maryland was attending a lecture on hygiene with his
classmates. A film on nutrition was being shown. The film was produced by
Hollywood films and filmed in Mayberry, Maryland at the Superfresh Supermarket
with Superfresh’s consent.
Halfway through the film, John and his classmates recognized John shopping at
Superfresh. At the time the film was produced, John was nine years old and extremely
obese. Since that time, he had undergone psychiatric counseling which had
successfully reduced his food intake and his weight so that he was now a good athlete,
well-liked by his classmates, and 120 pounds lighter.
The film depicted John in his obese condition eating a banana in the store. The film’s
narrator stated: “Some people are so obese they make monkeys of themselves,” as the
camera zoomed in for a close-up of John. It was apparent that John did not know that
he was being filmed and, in fact, neither he nor his parents had been informed about
the filming.
John’s classmates burst into laughter and began making monkey gestures. John
became the butt of many jokes for weeks on end. As a result, John developed
headaches and nightmares and he had to seek further psychological counseling.
Directions: Use your textbook, Maryland statutes, and the information discussed in
class, answer the following questions:
1. What, if any, tort claims can John bring? Please fully explain John’s chances of

Read and answer the following questions:
1. The practice of law considers the “Must, Can and Should” of ethical dilemmas.
According to the Maryland Rules, attorneys can disclose, but the dilemma occurs when
deciding should you disclose. Using the recent Highland Park, Illinois mass shooting as
an example, how would you reconcile your legal, ethical and moral obligation if the
shooter told you a week before the killing that they planned to commit such a heinous
crime? What does the law allow you to do?
2. Which of the following acts by a paralegal would be permissible and which prohibited
under the definitions of legal advice given in this chapter?
Interviewing a client to obtain the facts relating to an automobile accident
Telling the client that the firm probably would be able to get a $10,000.00
recovery
Explaining to the client what happens at a deposition.
Attending a deposition without a lawyer present
Telling a client that the best course of action would be to file a small claims action
Answering a client’s questions about the meaning of terms in a contract
