After reading Indian Justice: A Cherokee Murder Trial at Tahlequah in 1840, answer the following questions. You initial post should be at least 500 words long and is due before midnight on Thursday. Then, sometime before 11:55pm Sunday, respond to two of your fellow students posts with a post of at least 150 words. Focus primarily on responses to questions 2, 3, 4, 6, and 7. (Question 5 will be the focus of the second part of this discussion.)
Initial posts are worth 50 points, each response post is worth 15 for a total of 80 points for this portion of the discussion.

1.) What were the charges brought against Archilla Smith?
2.) What evidence was brought up against Smith?
3.) If given the job of prosecuting Smith, what if anything would you have done differently?
4.) If given the job of defending Smith how would you go about it? Do you think Smith’s counsel did a good job given the circumstances? Why or why not?
5.) If you were on the jury, how would you have voted and why? What testimony or evidence would be most important in your decision?
6.) Did you notice any differences in the Cherokee trial and a modern day trial? Explain.
7.) What do you make of Smith’s final speech on page 102?

This forum revolves around Indian Justice: A Cherokee Murder Trial in Tahlequah in 1840.
Before you post to the forum, answer the question in “choice 1”
Next write an answer to the forum question (your original post should be at least 150 words). Your initial post should be posted no later than Midnight on Thursday. The question is:
If you were a member of the jury on the trial of Archilla Smith, would have voted him guilty or not guilty and why? Be sure to explain why you voted the way that you did. This answer will be worth ten points.
You should have two response posts, worth five points each. The response posts should be posted before midnight, Sunday. One response should be to a post that agreed with your vote. The other response should be to a post that voted the opposite of how you voted. The two students who receive the most responses to their initial posts (one guilty, the other not guilty) will receive a ten point bonus on this assignment. Keep this in mind when you make your initial post. Being especially convincing on your initial post, might gain you more responses. Plus, the earlier you post your initial post, the more time fellow students will have to respond to it.
