R. v. Molodowic

Court case assignment (20%) due July 25th (5-7 pages). The purpose of this assignment is to provide a critical review of a relevant Canadian criminal Court case. Find a fairly substantive (i.e., > 20 pages) recent Court case wherein the fitness to stand trial of an accused was in question or wherein a ‘special’ defense (i.e., automatism, intoxication, NCRMD,) was used by or for the accused.
1) Provide a complete and succinct review of the facts/particulars of the case; 2) What is or are the main (mental health) issue(s) or arguments being made about the accused/defendant in this case; and, 3) Review (and comment on) the verdict or outcome of the case and how the accused/defendant’s mental health or state relates to fitness, automatism, intoxication, or NCRMD in this case;
Your preparatory research is important as you need to find a case that allows you to answer these 4 questions and examine the issues in a critical and thoughtful manner. You cannot review any of the major cases covered in the readings. If you are uncertain about your case, please contact the instructor.
