You will be drafting a six page (or less) analysis of your topic that focuses on the broad legal issues at play. Your paper should address the following questions:
1. What is the current state of the issue?
How have the courts or other legal bodies addressed these issues to date?
How satisfactory are the resolutions?
Is the issue settled or will it recur?
3. In your opinion, where should the issue move in the future?
Is further legal clarification needed?
Is the issue better addressed by the executive, judicial or legislative branches?
What are the consequences of the direction you suggest?
3. What is the significance of the issue you have chosen for the rule of law and the legal order in the United States?
N.B. I am not interested in extensive research. This paper should be thought of as an extended take home essay more than a research paper. I am interested in your ability to articulate legal issues in light of the topics and modes of analysis we have been discussing in class, i.e., with due attention to the structure of our government and the roles and competencies of the various governmental actors. I am more interested in your reasoning than your conclusion.
