I am writing an update of a law school textbook that covers HIV/AIDS and the Law. I am tasked with updating the AIDS and Employment Law section. Specifically, I need help with the state privacy laws section.
Your part is to take a look at state laws across the US that are aimed at protecting the privacy of people with HIV/AIDS (eg Illinois’ AIDS Confidentiality) as well as state laws that aren’t aimed at protecting people with HIV/AIDS per se, yet still offer protection (eg Illinois’s Biometric Privacy Act) in the employment context. You don’t have to look at every state, but you should aim to get a big enough sample to give readers a taste of what’s out there. Generally we want to know who the law protects, what kind of private information does it protect, how may the information be used if at all, and anything else of note.
