The final paper asks you to identify a complex environmental issue that implicates more than one environmental statute. For example, climate change, hazardous waste, and species protection are all issues in which policymakers, regulators, and advocates have applied multiple environmental statutes (e.g., CAA, CWA, CERCLA, ESA) to achieve their desired outcome. The goal of this paper is for you to see how many environmental issues have multiple dimensions that implicate a range of federal environmental statutes and policy processes. Be sure to provide specific cases and evidence.
Your paper should include:
A description of an issue (e.g., climate change, hazardous waste remediation, species protection) that implicates at least two federal statutes. You should describe a specific case or conflict associated with the problem, the statutes implicated, and how the statutes have been applied by policymakers, regulators, and/or advocates.
An analysis of how policymakers, regulators, and/or advocates connect these statutes to the issue. Your analysis should evaluate whether this application was appropriate and why or why not.
Analysis that addresses the following questions: Are the statutes sufficient to address the underlying problem? Why or why not? Do these statutes provide federal, state, and local jurisdictions sufficient tools to prevent or respond to the issue? Why or why not?
Recommendations for whether additional legal authority is needed to address the issue, or whether existing authority can be used more effectively.
