This week, you are asked to research and prepare a student brief for a case pertaining to the material covered in Chapter 5: Worker’s Rights as Human Rights: Health and Safety in the Workplace.
Specifically, find a state or federal case opinion that talks about a workplace injury using the research database of your choice – (I recommend Nexis Uni, [found here:https://libguides.twu.edu/az.php?a=n] but you are free to use whatever search engine / database that you are most comfortable with. A lot of students prefer Google Scholar (https://scholar.google.com/ (Links to an external site.))).
Once you have found an opinion, then please:
1) Provide a citation to the pertinent case in the format discussed in the first week’s slides
2) Write a short summary of the case discussing:
a. The underlying facts (no more than two-to-three paragraphs as this should be a summary of the case and not a recitation of the court’s language);
b. What is the question that the court is addressing in the opinion (no more than a paragraph);
c. What the court decided (no more than a paragraph); and
d. What rationale the court offered in support of its decision (no more than two-to-three paragraphs).
When finished, your summary should look like the case briefs found in the weekly lecture slides. Please review p.372-4 before you prepare your brief.
Finally, discuss whether you agree with the court’s decision and why.
Your response will be graded for its content as well as adherence to the requirements. I will be looking at your understanding of the case, ability to summarize it, and spelling and grammar.
