The statute of limitations is the time limit an attorney has to file a lawsuit in court. If the statute of limitations is not specified within the case, it will very easily be dismissed. Depending on the jurisdiction that the lawsuit is being filed, it may vary. Furthermore, that is why it depends on when the complaint was originally filed by the plaintiff. In criminal cases, depending on the extent of the crime it a statute of limitations may not be necessary. For example, minor criminal offenses related to sexual assault or battery may not require a time frame. According to the federal statute 28 U.S.C § 1658, ensures that except provided by law, a civil action arising under an Act of Congress enacted after the date of the enactment of the section may not be commenced more than four years after the cause of action.
