Compliance Scenario 1
Your office has been contacted by the Pediatrics Department in the case of a 10-year-old boy. The boy has a congenital heart condition that was noted at the last physical to have worsened since last year. His pediatrician referred him to a Pediatric Cardiologist for treatment which will likely include surgery to correct the condition. The boy’s mother, however, is adamant about not wanting her son to have surgery. She noted they have very specific religious beliefs and told the Pediatrician that surgery conflicts with those beliefs. The Pediatrics Department contacted your office for guidance on how to handle this situation.

Compliance Scenario 2
An in-house complaint has come in on your office’s anonymous tip line regarding nurses on the OBGYN Unit. The complaint alleges that a few of the nurses has been using their cell phones from patients’ rooms to monitor other patients. Although they don’t use last names, the nurses use moms’ first names and room numbers and will often reference, “her c-section,” or other medical details.
You are aware that the OBGYN Unit has been short-staffed for months and that these nurses may just be trying to save time by calling each other rather than walking from room to room. However, the person submitting the complaint is concerned this practice may be in violation of HIPAA.

Review the following scenario:
When the C Family’s twins were two weeks old, they developed staph infections. Treatment of a staph infection includes administration of IV Heparin, a blood thinner. Unfortunately, the pharmacy techs had delivered the adult concentration of Heparin to the pediatric unit, and the twins were given a dosage 1,000 times stronger than appropriate for their size and weight. Two doses were administered, eight hours apart, before medical personnel realized the error.
When the parents called to check on their babies that evening, they were told the twins were fine, even though the hospital had already begun treating them for a Heparin overdose. The parents were not made aware of their children’s conditions until the next morning when they arrived at the hospital and were greeted by the risk management team.
Once the twins had recovered, the C Family filed suit against the hospital and staff.

• From your view point, how could this situation have been prevented. Justify your viewpoint.
