Scenario 1 – Third Party Rights

Bobby was attending college two hundred miles from his home for the fall semester. Bobby’s wealthy aunt, Brenda, decides to give Bobby a car for Christmas. In November, Brenda makes a contract with Walker Ford to purchase a new car for $21,800 to be delivered to Bobby just before the Christmas holidays, in mid- December. The title of the car is to be in Bobby’s name. Brenda pays the full purchase price, calls Bobby and tells him about the gift, and takes off for a three-month vacation in Mexico.

Is Bobby an intended third party beneficiary of the contract between Brenda and Walker Ford?
Scenario 2 – Breach and Remedies

Candace Dixon agreed to sell Alana Mendes a house in Alabama for $205,000. The sale was supposed to close by November 30, when the parties were to exchange the deed for the price. The contract included a provision that “if Seller is unable to convey good, clear, insurable, and marketable title, Buyer shall have the option to: (1) accept such title as Seller is able to convey without reduction of the Purchase Price, or (2) cancel this Agreement and receive a return of all Deposits.”

An examination of the public records revealed that the house did not have marketable title. Mendes offered Dixon additional time to resolve the problem, and the closing did not occur as scheduled. Dixon decided “the deal is over” and offered to return the deposit. Mendes refused and, in mid-December, decided to exercise her option to accept the house without marketable title. She notified Dixon, who did not respond. She then filed a lawsuit against Dixon in a state court.

Discuss whether Dixon breached the contract and decide in whose favor the court should rule.

A question about members of the Congress and other legislatures

Description

All members of Congress are at one time or another confronted with the question: Should they vote according to their conscience or to the will of their constituents back home? In many cases, the answer is not easy. As political scholars have noted, voter input is often lacking on routine, complex, or “non-salient” issues. On other issues, voters may register opinions that are ill-informed or contradictory.
In each of these cases, what is a lawmaker to do?
Should a lawmaker pledge only to vote according to what he or she thinks is best? Or, should members of Congress consistently seek out voter input on all matters, even if voters do not seemingly care about the issue?

If you were elected to Congress, to which model of representation would you subscribe: delegate or trustee? Why? Would you try to combine the two into a hybrid model so that you acted as a delegate on some issues and as a trustee on others?
If so, how would you explain that to your constituency back home?

Diagnostic Writing activity: Two paragraphs

Discuss all the reading you have done since the summer. Please Include both “school” and “out-of school” reading. Try to list as many texts as you can think of, no matter how short and unimportant they might seem. Now, answer the following questions.
What was your purpose in reading each of those texts? Did you read for information, to pass a test, for enjoyment, to decide on a product you wanted to buy, and so on?
You have probably come up with a list of different purposes. How did each of those purposes influence your reading strategies? Did you take notes or try to memorize what you read? How long did it take you to read different texts? Did you begin at the beginning and read till you reached the end, or did you browse some texts? Consider the time of day you were reading. Consider even whether some texts tired you out or whether you thought they were “boring.” Why?
What did you do with the results of your reading? Did you use them for some practical purpose, such as buying a new product or finding directions, or did you use them for a less practical purpose, such as understanding some topic better or learning something about yourself and others?
