The field of history, like the field of education, is open to new interpretations as cultures, voices, and scientific studies changes our understanding of the larger world. As such, there are historical areas of higher education that merit further exploration and engagement. As such, this assignment will ask you to propose an area of historical exploration that you feel would benefit existing dialogues about the history of the field. You may choose to think of areas such as personnel that worked on campus that may not have had their history explored or to focus on the role that certain courses played in the history of education. You could choose to focus on alumni populations that are understudied or look at products aimed at educators in history. State ASSIGNMENT: John Doyle requested that our office represent Doyle’s Tavern in a detrimental reliance / quasi breach of contract action based upon government assurances that his business, and many others, claim they were misled by State’s Governor who, after three months into the COVID-19 pandemic, assured and publicly declared that bars and restaurants could partially reopen on July 1, 2020. Please review the following facts of the case, as well as the legal authority that I have provided, to determine the strengths and weaknesses of Mr. Doyle’s case. Discuss whether you think we have a good case against the State and discuss whether there are any defenses to the claim. In preparing your memorandum, please consult the sample Legal Memorandums in PCD and Statsky. Please note, this is a closed memo. Therefore, it is important that you do not conduct any outside research or apply any outside law in your analysis/conclusions. Apply the law as provided below. FACTS: In early March 2020, Olympus, a small country in the South Pacific, was bracing for an unprecedented dilemma in response to a global pandemic. Regions literally shut down across the country. This was mandated at the state and federal levels. All state governors were forced to order the shutdown of bars and restaurants. As summer approached, the national and state levels of infected citizens decreased, and on June 15, 2020, State Governor, Jane Kennedy, publicly announced that bars and restaurants in State could open on July 1, 2020 for partial indoor dining with restrictions on occupancy and “social distancing.” Doyle’s Tavern is located just off the beach in a summer-seasonal town on the coast of State. Doyle’s can hold 200 patrons in the indoor restaurant, another 150 in the Banquet Room and another 100 in outdoor dining. It has catering capabilities for private parties and weddings. Before the announcement, Doyle’s strictly followed State guidelines for outdoor dining, as they did minimal takeout. Outdoors, in good weather, they could, at capacity, seat around forty (40) patrons in the outdoor tables. Since early March, they continued operating while barely breaking even. John Doyle was content employing his staff on a part time basis. Once Governor Kennedy announced the indoor lift, Doyle’s, like many similar establishments, received numerous calls for reservations indoor, booked three weddings, and ordered $15, worth of fresh vegetables, lobsters, meats, kegs of craft draft beer, liquors, champagne, and fine French wines to accommodate the reservations and influx of indoor patrons. On June 27, 2020, in the wake of increasing cases of COVID-19, Governor Kennedy decided that it was nec‌‍‍‍‌‍‍‌‌‌‍‌‍‍‍‍‌‍‌‌essary to rescind the prior order and thus, cancelled the opening of all indoor activities, including indoor dining in all bars and restaurants. Nearly all of the items purchased by John Doyle in anticipation of the reopen went to waste when Doyle’s Tavern was unable to resume indoor service. LEGAL AUTHORITY: State Code Art. 2 § 1423. Cause defined; detrimental reliance A party may be obligated by a promise when he knew or should have known that the promise would induce the other party to rely on it to his detriment and the other party was reasonable in so relying. Recovery may be limited to the expenses incurred or the damages suffered as a result of the promisee’s reliance on the promise. Reliance on a gratuitous promise made without required formalities is not reasonable. (Note, Doyle’s is the promisee) In Gold Finger’s Casino, Inc. v. State Department of Taxes, 123 State 2d 456 (2000), the plaintiffs, Gold Finger’s, paid sales taxes under a newly enacted Casino law that was, in their accountant’s opinion, vague and conflicting. Gold Finger’s general manager contacted the Department of Taxes where an employee assured them that no taxes were due for that year. Two years later, the Department claimed that Gold Finger’s owed $30, in back taxes and penalties for the year in question. The trial court and State Court of Appeal found that although the taxes were due, the state was precluded from collecting them because of the doctrines of detrimental reliance and equitable estoppel. On further appeal, State Supreme Court disagreed finding that “detriment resulting from reliance simply has not been proved.” In considering Gold Finger’s, the Supreme Court noted four factors required to invoke detrimental reliance against a governmental agency. The additional factors include: “(1) unequivocal advice from an unusually authoritative source, (2) reasonable reliance on that advice by an individual, (3) extreme harm resulting from that reliance, and (4) gross injustice to the individual.” Here, Gold Finger’s had to pay the tax because the same tax was enforced against numerous other casinos, who also made a lot of money, and that Gold Finger’s failure to pay taxes was based on a misrepresentation by a rather high ranking state official who thought she had the authority to act accordingly. Under section 470 of the Public Health Service Act (64 Olympus Code § 541), the Olympus Secretary of Health and Human Services is authorized to take measures to prevent the entry and spread of communicable diseases from foreign countries into Olympus and between states. Further, the states shall have police power functions to protect the health, safety, and welfare of persons within their borders. To control the spread of disease within their borders, states may enact laws to e‌‍‍‍‌‍‍‌‌‌‍‌‍‍‍‍‌‍‌‌nforce the use of isolation and quarantine.

What makes this different from “historical fiction” is that it does not deviate far from facts.

There are many ways to learn: you can read a book, listen to a lecture, participate in a symposium or discussion, hear a podcast, watch a film, etc. Most of what I’ve assigned you this semester has been academic writing: dense, challenging, detailed, and somewhat dry, because the intent of the author is to meet the demands of scholarly rigor, to be beyond reproach in one’s claims, arguments, and analysis.
The reading for this week includes, in contrast, a sort of fictionalized history (see p. 4, beginning with “The setting is a room in a brick palace…”). The author fictionalizes the past, creates a narrative, and tells a story. She uses facts about history, but retells it as a story. What makes this different from “historical fiction” is that it does not deviate far from facts.
For this week’s assignment, write a 2-3 page creative essay, similar to the one in the reading. Base it on something you’ve learned in this class. For example, you might imagine someone painting a cave, or writing on a tablet, or painting a vase in the Neolithic period. Include as much of the texture of life as possible: the sights, smells, sounds of the world in which your narrative takes place. You will have to invent details since you won’t know everything, of course.
Include one final paragraph in which you reflect on what, if anything, you gained from this non-traditional form of writing.

this site within LDEQ EDMS based on the name and/or address. You may need
to review Google Earth for physical addresses to use in the EDMS research.
• If you don’t know the name of the gas station (i.e. Food N Fun 12), you may
have to search for it by city and type of site within EDMS or you can search
within EDMS using the physical address. This process was demonstrated in class.
• Download the most recent Compliance Evaluation Inspection (CEI) done by
LDEQ at the site. MAKE SURE IT IS THE MOST CURRENT CEI.
• Write one paragraph with 4-6 sentences that lists how many USTs are at the site,
what type of fuel each one stores, and their individual capacities in gallons.
Review the beginning pages of the CEI and find out the type of tanks they are as
well as the material the product lines are made of that transfer the product.
• Attach a cover sheet to your narrative with your name, the date it was turned in,
the name of the site, the site address, and the LDEQ Agency Interest (AI)
number. Attach the CEI download.

familiar with or interested in, locate ANY other NON-UST site in
the State of Louisiana in any city or parish.
• Find a small site such as a dry cleaners, body shop or any type of
smaller industrial business, active or abandoned, that is not a UST
site. Avoid large facilities with multiple pages of records.
• Provide the name of the site, the site address, and the LDEQ
Agency Interest (AI) number.
• Open the EDMS files for this site, review the material and write a
paragraph with of 4-6 sentences that briefly summarizes why
LDEQ went to the site and what was accomplished as well as the
current compliance status. Try to determine if the site is active,
closed or abandoned.
• You can combine the information found in EDMS with outside
sources of information that you may refer to from a Google
search or other source.

Multiple-Case Case Study Assign

OVERVIEW
Multiple-case case studies allow the researcher to use replication logic to evaluate the theoretical propositions and strengthen the findings of the studies. In this discussion, the example of a multiple-case study would be the culture of compliance to environmental regulations within investor-owned electrical utilities, local municipal electric utilities, and federal electrical utilities. The application of the same case study construct to the three distinct types of electrical utilities allows the researcher to show potential trends of similarity or differences. The researcher is then able to compare the trends and findings against the theoretical propositions to determine the validity of the study. The synthesizing of the data across three separate types of utilities allows the researcher to address outlier and rival explanations as a part of the research findings. As a consultant to the Kansas state leadership, the student will discuss what this Multiple-Case Case Study brings to bear on the source selection of the electricity provider for the state. The student must specifically speak to the application of a couple of business solutions (i.e. does this study identify a single solution or could it be parlayed into a range of solutions, do the outcomes of this study bring a scalable solution, what’s the difference between this and a simple business case analysis or cost benefit analysis, etc.)
(NOTE: Even if not officially wearing the title of ‘consultant’ in your organization, you may be asked to provide a business solution to an internal organizational issue. Regardless of titles, these scenarios are designed to get you thinking about how to apply the applicable case study to a certain type of issue.)
