As part of the preparations for the legal case involving the employee in the scenario you selected in Unit I, you are now asked to provide an assessment of the organizations personnel management program, including processes used to ensure personnel are competent to fulfill their duties, have clear guidance, and are made aware of policies and procedures that will impact performance. You should discuss the local and state laws that may apply and their legal implications in this scenario.
Continue using the same organization on which you based your Unit III assignment research.
You should prepare your assessment as a report that responds, but is not limited to the following questions.
What processes are in place to ensure the new employee has read all organizational policies and procedures?
What evidence is there that the employee is aware of the expectations for their position?
Does the organization have a drug-free workplace commitment? How is this monitored?
How are personnel certification and licensure renewals handled?
How are ongoing competency and ability to perform the duties of the position monitored?
Your paper should include a brief introduction of the scenario. You may include other tools for personnel management that you feel may be relevant to the case.
Your paper should be a minimum of three pages, not including the title and reference pages.
You are required to use a minimum of three sources, one of which may be your textbook. These may include peer-reviewed articles, professional organization websites, and government websites/documents.
All sources used must be referenced; paraphrased and quoted material must have accompanying citations. All references and citations used must be in APA style.

Case Study:
Side Bar Considering Malpractice
Consider this example of a medical malpractice action: Two EMTs are called to transport an elderly male from a nursing home to the local hospital. They arrive at the scene and observe that the patient is morbidly obese and has a BiPAP in place. The patient is in respiratory distress. The EMTs place an O2 saturation detector on the mans finger and see that his O2 saturation is only 84 percent. The patient is moved to a stretcher, and the EMTs attempt to intubate him after administering a paralytic through IV tubing that was placed by the nursing home staff. One of the EMTs misses the first intubation and must ventilate the patient for 2 to 3 minutes with a bag-valve mask. Both EMTs reattempt the intubation two more times, and on the third try, using an endotracheal tube with a lit stylet, they believe that they are in the trachea but fail to confirm placement of the tube following local protocol. The transport time is 15 more minutes. At the time of arrival at the emergency room (ER), the ER physician discovers the tube placement is in the esophagus, so he reintubates the patient, who immediately goes into cardiac arrest and dies.

Organizations can undertake marketing initiatives for various reasons as the company aligns its organizational strategies with its marketing strategies. Companies can look toward growth strategies or consolidation. If the company wants to grow, it can do so using market penetration, market development, product development, or diversification. By understanding these elements, you will be able to build more effective marketing strategies.

Strategic Advantages
Growing organizations have a number of strong marketing strategies that they can employ effectively. These strategies include market penetration, market development, product development, and diversification, each of which is described below:
Market penetration is selling more of the existing services and products to customers within the existing market.
Market development is finding new customers to sell existing products and services.
Product development is developing new products to sell to existing markets.
Diversification is developing new products or services and selling them to new markets.
In addition to these common strategies, a healthcare organization can form strategic alliances with or acquire other businesses. Another key strategy that companies can undertake that would affect the marketing plan is consolidation strategies. This might occur when the economy is shrinking, or when a firm wants to concentrate on providing products and services in just a few areas. This strategy allows companies to avoid working in areas that are not their competitive strength- reducing the number of services they offer and focusing more exclusively on their specialties.
Premier PEST Analysis
Previously, we noted the effectiveness of a SWOT analysis when building a marketing strategy. In addition to a SWOT analysis, it is strongly recommended that an organization consider performing a PEST analysis as well, which reviews the political environment, economy, social environment, and technology (Post, 2018). Each of these elements is fairly self-explanatory.
The political environment looks to analyze the political climate, something which is often very volatile. The economy attempts to examine outside economic issues to determine how it might impact the practice. The social environment reviews the socioeconomic environment around the market, attempting to pinpoint how demographics will factor into how a product or service will ultimately sell. Finally, as noted previously, technology is always advancing and must be watched constantly to remain on the bleeding edge.

Even people whose income is well above the poverty line can sometimes find it difficult to make ends meet. Imagine a family of four living in your hometown. Suppose that there are two adults and two children in the homeone child is 7 years old and in elementary school and that the other is 3 years old and must be cared for during the day. Design a budget; make a list of all the goods and services this family needs to function. Be as complete as possible; be sure to include: food, clothing, housing, transportation, healthcare, childcare, utilities, cell phone, cable, entertainment etc. Estimate the monthly cost of each expense. You can utilize the internet to get estimates if you do not have these bills yourself. Total up your expenseshow much do you need to make a year to pay all these bills?
The 2021 poverty threshold for a family of four is $26,500 (up from last year’s $26,200). Look for ways to cut your original budget until you reach the poverty line. For example, if you originally estimated a housing/mortgage payment of $2,500, obviously, you will need to move this family into a smaller apartment. If you allocated $600 a month for food, how much will you need to lower this to? The point of this assignment is not to just present these tables but to analyze them. If you had to cut your food budget, what are the consequences of this? If you cannot afford your own home and live in a one-bedroom apartment what will the impact on your family will be? If you take your 3-year-old out of daycare and have them stay with grandma, what are the consequences of this? What is it like to be working poor? What type of things do these families have to live without (things you might take for granted)? What is the impact of poverty on children in poverty? How will the familys difficulty in meeting its basic subsistence needs translate into access to opportunities (education, jobs, healthcare) for their children later in life? Finally, what does this also say about the root causes of poverty? Maybe people are being crippled by housing, education, and healthcare costs that have grown exponentially, while their wages have remained relatively stagnant. This is not a laziness problemthis is a structural problem!

Do not just submit a budget. You need to write a critical essay analyzing the cuts you made and the effects of poverty on US families.

Week 6 Discussion

Since 1977, the decision in the Abood v. Detroit Board of Education was used to set the standard for payment of dues by both members and non-members in an environment that was considered to be an agency shop. An agency shop is a unit or department where a union is stated to be the representative of all employees, including both members and non-members (Schudroff, 2018). The Abood case examined Michigan statutes that permitted this designation. The Abood case stated that payment of fees by all receiving representation was necessary to ensure the vision of federal labor laws were being met and followed (Schudroff, 2018). However, Abood also recognized the First Amendment violation that can occur if someone is forced to make contributions of a political nature. The answer to this potential conflict in the Abood case was called a fair share fee. This fee allowed the union to calculate the cost put toward negotiating and bargaining without other unrelated expenses being figured in (Schudroff, 2018).
In 2018, the fundamental idea behind the Abood decision was called into questions when Mark Janus who worked for the Illinois Department of Healthcare and Family Services challenged being required to pay fair share toward an organization when he opposed their policy positions (Schudroff, 2018). The Janus case called into question if workers being required to do this was actually a violation of the First Amendment rights to freedom of speech and association (Schwab, 2021). Janus is a landmark case because of the national impact on unionized members working in public education, first responders, and government employees (Schwab, 2021).
I have personally been impacted by this scenario. When I first began my career with Cincinnati State which is a highly unionized college with representation from AAUP 1, AAUP 2, SEIU, and FOP which includes almost every full-time employee. As part of the early weeks of my training, I was visited by a union representative from SEIU which supports most of the administrative, non-advisor, faculty, or public safety positions on campus. At that time, they explained how union membership and the fees would work. I remember asking specifically about if I did not want to join. The representative shared that I would have to pay the fee regardless, so I might as well enjoy the benefits. There was no explanation as to why this was. This exchange took place in 2015, and now for the first time ever, I know it was related to rulings like that in Abood.
In the aftermath of the initial Janus ruling it appears that many states sought legislation to help unions access new employees (Schudroff, 2018). I feel like financial concerns can make organizations adopt questionable practices and I am concerned that if the states expand access to new hires without monitoring the practices, there could be problems that stem from this. Another potential option would be a more customized approach. For example, it would allow employees to opt into the specific services they wanted (Schudroff, 2018). I think this would most commonly be seen connected to grievance processes, mediation, and collective bargaining agreements.
While I do not always agree with the culture of unions and I was resistant to union membership, the union saved my job in 2016. When Cincinnati State severed ties with Pearson Education who my department operated under I was given the opportunity to move into another SEIU vacant position or to bump and person with less time because of the collective bargaining agreement terms that I was covered by. Because of this, I do not know if one extreme or the other would be the best approach as seen in Janus. However, I think a hybrid approach like described that allows people to choose the benefits they want would be a solid compromise. In the public sector roles impacted by Janus, there is often rapid changes than can lead to tremendous job impact and because of this, not having union protection is an intimidating thought. Each person making an educated decision seems to be the best option to me. However, in this system, the unions will lose some funding which could present a new set of problems to be addressed.
