Living Cultures

This is a short report assigned in lieu of a midterm exam. The goal of the assignment is to understand that Native people and their communities are alive and kicking. They do not just exist ‘in the past’–as they are often misunderstood or stereotyped to be. Their resiliency and adaptation, their commitment, and endurance are extraordinary. They have never stopped working hard to survive and thrive despite the brutalities of over 500 years of colonialism.

STEP 1: Pick TWO articles from either one of the two online newspapers below. You can choose one article from each online newspaper, or you can choose both articles from the same online newspaper. They must both be articles about what TWO Tribal Nations (or two different confederacies/alliances of Tribal Nations) are doing currently (within the past few years). Pick what interests you–pick what you’re passionate about.

STEP 2: Write a total of THREE pages, covering both articles. The entire essay must be a minimum of three pages, double-spaced. Or you can write as much as want. At least one page must be given to EACH of the two articles. You could write one page on one article and two on the second article. Or you can split the essay evenly and write a page and a half for both articles. The essay should 1) give a short ‘book report’ on what each article was about, and 2) give your own short commentary on each of the articles. I encourage using some outside research, but it is not required.

STEP 3: Upload it to this assignment box as either a Word or a pdf file.

equity and trusts

After 1873 there is no need for a course on ‘equity and trusts’, only a course on the law relating to trusts. Equitable doctrines and remedies relating to contract should be taught in a course on contract; likewise, equitable doctrines and remedies relating to tort, property and unjust enrichment should be taught in courses focusing on tort, property and unjust enrichment.
Explain and critically evaluate this statement with reference to fusion and the tradition of equity.

Electronic Transactions

Electronic Transactions:
Should only banks and regulated financial institutions be allowed to issue ATM cards? Why or why not? How else might the government regulate digital funds to reduce the potential for cyber laundering?
Is private electronic “cash” legal? To what extent should private authorities be liable when a fraud is perpetrated in the context of an electronic transfer of funds via the Internet? Is the current law sufficient in this regard? If not, what changes need to be made?
