You almost certainly are or have been a party to a contract. Do you have a lease agreement on the place where you live? Have you bought a house and did you sign a promissory note promising to pay the bank what you borrowed from it? Have you bought a car, appliance, or household good on credit so that you are making payments on it, or do you have a credit card? Go find one of these contracts (or the contract of a friend or relative) and read it. Tell me:
what contract you looked at.
what, if anything, your contract says about
your right or the right of the other party to assign the contract to someone else;
what constitutes a breach of the contract;
what it says about damages that may be payable in the event of breach; and
whether it requires you to pay the attorneys fees of the other party if they sue you for breach; and
Assume you take your fur coat to a consignment store in town and leave it there to be (hopefully) sold. If the consignment store burns down while the coat is there, whose loss is it? Why? Fully explain your answer.
