Question:
Identify a crime in NSW as per the Crimes Act 1900, the Summary Offences Act 1988 or
related legislation such as the COVID-19 Legislation Amendment (Emergency Measures—
Miscellaneous) Act 2020.
Research the occurrence of this crime (e.g crimes rates identifying how often it is committed
and/or tried) and the penalties it attracts (e.g imprisonment, fines, corrections orders).
Research the circumstances in which this crime is committed and the demographic of those
who are often arrested for this crime. You may choose to focus on a particular demographic
as a subset of those who commit the crime (e.g. young offenders arrested for arson; First
Nations Australians arrested for offensive language; women arrested for social security
fraud, etc).
Considering all of the above, discuss whether or not alternative approaches to justice such
as restorative justice, reintegrative shaming or responsive regulation (or a combination of
these) would be appropriate in addressing the crime as you have identified it. Critically
analyse the benefits and the disadvantages of the alternative approach and compare these
to the current approach of the NSW justice system. State whether or not you would
recommend replacing or supplementing the current approach of the NSW criminal justice
system with an alternative approach such as restorative justice, reintegrative shaming or
responsive regulation (or a combination of these).
