Discussion 4.1
Charlie was arrested on a robbery charge. Upon arrest, Charlie
immediately stated he wanted to talk with his lawyer, which shut off any
further police interrogation. While Charlie was in jail awaiting his
preliminary hearing, police placed an undercover agent in Charlie’s cell. The
agent questioned Charlie about a different robbery than the one he was just
charged with. Charlie, not knowing he was speaking to police at the time, made
several incriminating statements about the other robbery, bragging about how
much money he was able to score and about the methods he used to escape.
Charlie is then released on bail pending trial on the first robbery.
A week later, a different police officer, unaware that Charlie
invoked his right to counsel, asked Charlie if he would talk with him about the
third robbery. Charlie agreed to talk about this third robbery and proceeded to
make several incriminating statements about that crime. He was later arrested
and charged with the third robbery. A few days after this arrest, Charlie was
charged with the second robbery he confessed to the undercover agent while in
jail awaiting his hearing.
Before trial, Charlie moves to exclude the statements made about
the second and third robberies because they were obtained in violation of his
right to counsel. Please evaluate the claims Charlie may have regarding the
statements made about the second and third robberies and the likelihood of
success in having these statements excluded from evidence.

Discussion 4.2
Pat is charged with aggravated assault in the U.S. District Court
for the District of West Virginia. The government alleges Pat struck Jimmy over
the head with a small baseball bat while the two were standing on the steps of
the Robert C. Byrd Courthouse in Charleston. Pat claims that he acted in
self-defense. The following testimony was offered at trial.
Ahmed testified that he is personally acquainted with Pat and has
known him on both a business and a social level for the last eight years. Ahmed
also testified that he lives in the same neighborhood and works for the same
company as Pat.
Pat’s lawyer asked Ahmed, “In your opinion and based on your
personal observation, is Pat a violent or peaceful person?”
The prosecutor objected, but the judge nevertheless required Ahmed
to answer the question. On cross-examination, the prosecutor asked Ahmed:
“Have you heard that Pat has a prior arrest for assault and battery?”
Pat’s lawyer objected, but the judge compelled Ahmed to answer the
question.
Later, the prosecutor called Wayne to the stand. Wayne testified
that he arrived at the scene of the altercation between Pat and Jimmy just as
it started. Wayne then testified that a bystander exclaimed to him: “I was
talking to Jimmy when Pat attacked Jimmy from behind.” Pat’s lawyer
objected to Wayne’s testimony and moved to strike.
1. Explain whether the judge’s ruling on Pat’s lawyer’s question
was proper.
2. Explain how the judge should rule on Pat’s lawyer’s motion to
strike.
