The burden of proof is on the prosecution and state to prove in criminal cases in which they have to prove beyond a reasonable doubt. The term to “prove beyond a reasonable doubt” means “the prosecution must convince the jury that there is no other reasonable explanation that can come from the evidence presented at trial.” There should not be any doubt in the jury’s mind and they should be certain that the defense is guilty. In civil cases the burden of proof is on the accuser and they only have to prove higher than fifty percent compared to criminal case which is to be one hundred percent certainty. I believe the reason the punishment was so harsh to encourage the people to not commit any crime and to live peaceably with their fellow brethren. Also, the harsh punishments seem to show the power and strength of the King or government. I also believe its to remind the people on a daily basis of who is in charge and to control the status of the people. I believe it put fear in the people to reduce any type of act of rebellion. I also believe the high burden of proof for accuser is to keep false accusations low or to not have any false accusations at all.

every civilization there is some sort of cost that comes with it. With your posed question being the cost of civilization being a social hierarchy then yes. If we compare social status and social hierarchy to today’s society we most definitely see the structures in all countries. Each country containing a different statue on this topic. This idea of the rich feeding off of the poor comes from the social class triangle; with the rich and wealthy being at the top, middle class in the middle, and the poor being on the very bottom. Each class benefiting from the next not allowing room for growth. No matter how much the poor class comes to the middle class, neither the poor nor the middle class can obtain the same power as the top tier in the social hierarchy triangle. For example, England has a royal family which was only given by bloodline compared to the USA where elections are held in place for the political face. Unfortunately the sad reality of social hierarchy existing has to do with each country having their own set of rules, something we must abide by in order to live on that designated land. Now the question stands, do I think it’s worth it? No. Gaining a social upstanding in the society cannot be obtained by everybody. The rich always stay rich while the poor make them richer. This can be seen through labor duties, contracts people are forced into, or even place of living (comparing a lower class neighborhood to a higher one). The cost of civilization might as well be entirely due to the social class structure.
