Introduction
Warner-Lambert Company manufactures and distributes Listerine antiseptic mouthwash and has since 1879. The company represented for 100 years that Listerine prevented and cured the common cold and sore throats. The Federal Trade Commission filed a false advertising lawsuit against Warner-Lambert alleging false advertising of Listerine. The district court found for the Federal Trade Commission and then the court of appeals affirmed the decision of false advertising on the part of Warner-Lambert Company.
