Daubert and Frye
Daubert v. Merrell Dow Pharmaceuticals remains a work in progress, in that the courts continue to amplify, limit, and clarify its scope. Whenever a case changes a landmark case law (as in Daubert), these subsequent cases are referred to in legal terms as the progeny of the landmark case. In other words, Daubert poses some gray areas, especially in the specifics of how it is to be applied, and the courts are still sorting these out.
Using your forensic report, analyze how well the methodology (including psychological testing) satisfies Daubert as you understand it. Also, it should be noted that some states still follow the Frye standard and have not adopted Daubert. Identify which admissibility standard applies in your state.
