Is it legal to weed out applicants through public social searches?

from SHRM: Social media is an umbrella term and refers to “media” (a video, text, picture, podcast, etc.) being shared (“social”) on Web-based applications for others to interact with by posting, sharing and commenting.
While workplace use of social media is now mainstream, its use has evolved in recent years. While lost productivity was the overriding initial concern, how to harness the power of social media has moved to the forefront.
