Discussion Question (Ch. 15) Judicial Philosophies
The philosophy of judicial restraint says that judges should interpret the Constitution according to the plain meaning of the words in the document. The philosophy of judicial activism says that judges should go beyond the plain meaning of constitutional language when interpreting the document. Which of these views do you agree with, and why?
