Abortion has been a contentious ethical and moral issue for ages. Since the 20th century, when healthcare practitioners could perform surgical abortions successfully, intense moral debates have ensued. Others argue that it is purely a liberty right without considering the moral repercussions of the act, while others argue that it is morally wrong. However, understanding when the unborn child becomes a person deserving of moral respect is crucial in addressing the debate.
Proponents of abortion have often argued that all humans have the liberty to engage in certain acts. Before the recent Supreme Court ruling overturning Roe versus Wade, the liberty to abortion was protected under the 14th Amendment of the United States Constitution (Moreland, 2021). The overarching argument about abortion as liberty protected by the 14th Amendment is that all women should have the liberty to make autonomous decisions about a pre-term baby.
The issue with the argument about the liberties of the mother is that it does not consider the moral rights of the unborn fetus. Many ‘pro-choice’ proponents who support abortion argue that a fetus is yet to form into a person and the decision solely rests on the mother (Pruski et al., 2022). In contrast, opponents of abortion argue that a fetus has the potential to become a person who can make rational decisions about itself. Thus, people should consider the fetus’s moral respect like any person. In this sense, abortion is mainly a moral rather than a liberty rights issue.
Many individuals have adopted a hybrid standpoint on the issue relating to when a fetus acquires the right to moral respect. An embryo has no basic essence of a human, while a fetus has developed fundamental capacities that qualify it as a person (Symons, 2018). Furthermore, a developing fetus has developed to a level that exhibits the potential to become a person and achieve rational capacity. Thus, the late-term fetus has earned the right to receive moral respect.
Recognizing when an unborn fetus becomes a person worthy of moral respect is critical to resolving the debate. Arguments supporting abortion based on liberty rights do not consider the moral implications of the act. However, from a moral standpoint, the ‘personhood’ of the fetus becomes crucial. When the fetus develops, it attains the potential to become a rational human, bestowing it the right to moral respect.
