Hello to everyone and welcome to our final week!
I believe that when it comes to patents, they are important in order to protect the person’s ideas. I believe one of the biggest challenges in getting patents in proof that the idea was yours and that it isn’t already patented by anyone else. There are so many people in the world and it would be easy for multiple to have the same ideas. I think this makes it difficult because of multiple people submit a patent for the same ideas, it would be hard to figure out who had the idea first. The type of product might also make it hard to gain a patent as well. As far as the number of applications, that reverts back to so many people being able to have the same idea or similar ideas. I think the fact that you could have pretty much the same thing but it different variations or designs is a reason there are a lot of patents as well. People will often come up with ideas from other people ideas that they can patent as well.
I think that the United States provides sufficient protection for these patent holders. I believe that if they did not, then you have have a whole lot of people not being able to make money off of their ideas and not being credited for their hard work. I think that if they weren’t providing the right protection, then there would be utter chaos among people.

Patents protect new products or inventions that people come up with. The U.S. Constitution protects the inventors. Utility and plant patents are protected for 20 years. Design patents are protected for 15 years. Patents have requirements to obtain. They must be new, useful, and non-obvious. The hardest part of getting a patent is determining if something similar to your invention is already patented. There are law firms who will help research, but this will cost you money. You will also need to keep records of your invention. This allows you to show when you started to work on your invention if others have a similar idea. Digital files with timestamps are important. The government will also require a prototype. Patents can cost as much as $20,000. A smaller company or person should file a provisional patent application. This gives the inventor a year to keep working and improving their invention. This protects the inventor from another person getting a patent first. I think technology has increased the number of patents. I also think better education has allowed people to use technology to come up with better ideas. Technology increases yearly, probably daily. Look at the first cell phone until today. Many improvements are made to the cell phone industry. The U.S. does a good job protecting patents. The Constitution protects patents along with the filing process and the monetary damages and injunctions against those that try to steal or use others’ ideas.

Insider training should not be legal. There is too much negativity to the entire process. The one that is benefitting from it is the only one that probably thinks it should be legal. The biggest issue that comes from insider trading is that the entire stock market does not have access to the information. This creates a very unfair advantage to all in the market except those who are benefitting from the knowledge. The investor who has access to the information will be able to make much larger profits from the information than those who are also in the market. The dangers that come with insider trading are mainly from the legal standpoint. There is a danger of creating an unfair market. There is also increased legal fees, government involvement, and public attention that creates public distractions. It is important that insider training remains illegal to promote fairness across the entire trade market. The only pros that come with insider training are that they are beneficial for the participants. Insider trading would create an unfair advantage to any not involved in the trading. If it was made public, then it would be useless, because the market would basically be the exact same way it is now. By legalizing it, however, the advantage would be too great to those involved. The law should remain in place to promote sustainability around the market. The most recent case of insider trading that I have heard about was an NFL player who got involved. He has now gotten out of jail and has to do community service and is currently on probation.

I enjoyed reading the article “Why Legalized Insider Trading Would Be a Disaster.” The article had a lot of great information held within it. When I first looked at the discussion question prior to reading the article, I was unsure how I would respond. However, after reading the article I 100% think this should not be legal. There are a few reasons as to why I think it should not be legal.
As I respond to this discussion post question, I immediately think insider trading should not be legal. It seems as though there is way to much negativity within the process. In my opinion, nothing good comes from a negative mindset. I disagree with the arguments held within the article. There are serval issues that come from insider trading. One of the biggest issues is, the stock market does not have any access to the information. Promoting an unfair market would cause a lot of bad things to happen. Insider training would essentially enable an unfair market. Insider trading should not be legalized. There are a few reasons why this should not be legalized. It promotes an unfair market, as I stated previously. Furthermore, it is a huge legal mess that can be prevented. Insider trading causes dangers, mostly from the legal aspect of things. Dangers/risks are expected, but can ultimately be prevented. Many risk factors come when discussing insider trading. It is always a good thing to stay away from risks. Although, risks are inevitable, trying your hardest to stay away from them is best.
