Select one (1) federal agency (U.S. Department of Education) and one (1) state agency (Arkansas Department of Education) and write a
short memorandum (2-3 pages) that contains the following
information and discusses the following issues:
• Citation to the enabling legislation for each agency, including
when it was passed and enacted and any interesting legislative
history regarding its passage;
• Citation to relevant provision(s) in the U.S. Constitution (for the
federal agency) and the state constitution (for the state agency)
supporting each agency’s existence and jurisdiction;
• Analysis of each agency from a separation of powers
perspective, including agency structure, constraints on
delegation, appointment and removal of officers, and agency
functions; and
• An example of a separation of powers controversy involving
each agency and the outcome of the controversy.
The state agency selected can be from Arkansas or from the state of
your residence.
There are various formats appropriate for professional memos. A
simple Google search will provide several examples. The content on
the memo is the most important. However, you should take care that
your memo is appropriately formatted and identifies the sender,
recipient, date, and subject.
