1. The police have search warrant to search Alan’s apartment for a wanted criminal. While conducting the search, an officer opens a closet. In it, he sees a sawed-off rifle, which is illegal. The officer seizes it. Can the seizure be justified under the plain view doctrine?
2. The police have arrest warrant to arrest Bill. Bill is in his friend Sam’s house. The police go the house and ask Sam for permission to get in to arrest Bill. Sam refuses. The police, after informing Sam that they have an arrest warrant, force their way in and arrest Bill in the kitchen. On the kitchen table the police see a bag of cocaine and seize it. Can the seizure of the drugs be justified under the plain view doctrine?
3. The police have search warrant to search Charlie’s apartment for drugs. While executing the warrant in the apartment, one officer sees several i-Phones on the dining table, which reminds him of the stolen i-Phones reported a few days ago. The officer cannot determine right away whether the phones are stolen. He turns over the phones to record the serial numbers and reports them to the headquarters. The headquarters confirm that the phones are stolen. The police seize the phones. Can the seizure of the phones be justified under the plain view doctrine?
4. Officer Smith has probable cause to believe Nate is involved in a burglary into a jewelry store. The door of the store was pried open by a pry bar and some diamond rings were stolen. The officer applies for a warrant to search Nate’s house for stolen rings and the pry bar. The magistrate issues a warrant authorizing to search for diamond rings but not for the pry bar. At the time of the search, Officer Smith is still interested in finding the pry bar. He opens a closet and finds a pry bar. He seizes it. Defense counsel argues that the seizure of the pry bar cannot be justified under the plain view doctrine for the discovery is not inadvertent. Can the seizure of the pry bar be justified under the plain view doctrine?
