What do you think about that? Fair game? Certainly posting on here own time and not on work time.
Here is another scenario. Jackie is being considered for a job a ACME INC. She has an interview, but a person who was once friends with her hears about it. Jackie’s Instagram Account is private, but this friend, now enemy is still able to see Jackie’s Instagram account. Her name is Sally. Sally gets on Jackie’s Instagram and downloads several pictures of Jackie smoking pot and making inappropriate racial comments on her Instagram. Sally mails this material to Acme’s Human Resources Department and Jackie does not get the job after Acme Human Resource personnel review the materials sent by Sally.
What do you think about this?
Some of you have mentioned Title VII. Let’s chat about it a bit here as we conclude our week…
Why is the purpose of Title VII? Under Title VII, all aspects of the employment situation are covered under the Act. Hiring, firing, promotion, demotion, ect, are covered.
One of the most typical claims under the Act relates to hiring practices by a covered group employer. These cases typically fall under a disparate treatment claim. What is a disparate treatment claim. These cases are now based on the McDonnell Douglas v. Green Supreme Court case. Under the case, the Court set forth what each party must do to prove a disparate treatment case.
