Angel Mountain Coffee, a drive-thru coffee shop in Texas, opened in 2005 under the old owner Howard, but the business never made a profit. Reviews were poor overall, employees dressed however they wanted, and he had 4 employees; comprised of three women (Janice- 44 y/o, 1 year experience, Bethany- 18 y/o, 3years experience, and Amy- 16 y/o, 4 months experience) and one male (Kevin- 26 y/o, 2 years experience).

In 2018, Howard sold the business to Jim, a young entrepreneur. Jim decided that the business needed to be more competitive, so he mandated that all baristas would now serve the coffee in bikinis during the day and in lingerie at night. He immediately fired Kevin, telling him he didn’t fit the image of the new idea. He then told Janice, Bethany, and Amy about the changes.

Address the following questions separately so I know which one you are answering, use facts and arguments to back up your points, cite sources.

Question 1: Can Jim fire Kevin? Why or why not?

Question 2: Janice says she is not comfortable wearing that. Jim says she must or she will lose her job. Can Jim fire her for not wearing that?

Question 3: Bethany says she’ll gladly wear it, but asks if her pay will increase for wearing it. Jim says no. Can Jim give an extra requirement without additional pay?

Question 4: Amy thinks it is a great idea. Can Jim make Amy do this? If so, can Amy consent to this?

Immediately after implementation, business profits showed improvement, so Jim sought to expand the business by making it 24 hours. To do this, he needed to expand the staff to 12. He writes a brief job descriiption that says

‘Now Hiring: Barista needed to serve coffee and treats. Must have friendly disposition, ability to multitask, and have appropriate experience and/or qualifications’. He has all applicants fill out an application as well as include a full length photo.

Question 5: Is Jim ok in how he wrote the job descriiption? Why or why not?

After a week, he looks at the list of applications he’s received and decides who he will interview:

He interviews Kelly, a 19 year old college student, who has never held a job before. She is hired.

He interviews Monica, a 35 year old mother of four children who last held a job when she was 22. She is not hired.

He interviews Taylor, a 25 year old transgendered woman who previously worked as a waiter. She is not hired.

He interviews Carmen, a 22 year old toothless woman who previously worked at Starbucks as a barista. She is not hired.

He interviews Regina, a 33 year old ex-con who currently works as a stripper. She is not hired.

He interviews Mona, a 76 year old woman whose husband recently died. She is not hired.

He interviews Lauren, a 41 year old former meth addict who was fired from her last job at Target for failing a drug test. She’s now 3 months sober. She is hired.

Question 6: Is Jim in trouble for only hiring two of the applicants? Should he be forced to hire all of them since he sought to have 12 employees?

As this goes on, Rather than fire Janice for not wearing the bikini and lingerie, Jim has Janice work in the backroom, away from customers. She gets disgruntled and she gets in touch with Kevin, and they decide that she will quit so they can sue Jim together claiming discrimination.

Question 7: Are bikinis/lingerie the uniform of the business? Can he mandate this?

Question 8: What if Jim buys the bikinis/lingerie and hands them out to the employees to wear while working does that change anything in your mind compared to if he just says for them to come to work in a bikini or lingerie?

Question 9: What product does this business sell?

Question 10: Does Janice have a cause of action for making her work in the backroom because she wouldn’t wear the bikini/lingerie?

Question 11: Does Kevin have a cause of action especially if Jim never sought to make him wear a bikini or lingerie?

Question 12: Can any of the not hired applicants sue for discrimination? If so, which ones?
