The paper will be completed in several stages during the semester and must include a section about the legislative history of the statute selected for the policy paper. Federal statutes are strongly recommended for this project. The first few weeks of class will consist of review of the legal research topics which tie into the legislative policy paper assignment.

Topic: Education as a Fundamental Right.

I think this is important because I believe everyone should have access to quality public education. Although it is not currently, I believe Education should be a constitutionally protected right.
ABSTRACT:
This paper examines positive rights under the United States Constitution. The essential question is whether the Court should ever recognize positive rights, like the right to public education, as fundamental rights under the U.S. Constitution? Positive rights under the U.S. Constitution can best be explained as rights that provide citizens of the country with tools, they may use to secure their health and well-being. Without a doubt, the Supreme Court should recognize positive rights, like the right to public education, as a fundamental right under the U.S. Constitution. Part I of this article will summarize three articles involving the right to education. Part II will discuss the role and policy analysis of the Court’s interpretation of the right to education. Finally, part III will discuss the legal theory behind the Court’s interpretation.
