Torts Analysis & Torts & Ethical Dilemmas Questions & Alton Logan’s Attorney-Client Privilege

PART 1:
Torts Analysis
On December 10, 2019, John, 14 years of age and an eighth grader at Mayberry
Middle School in Mayberry, Maryland was attending a lecture on hygiene with his
classmates. A film on nutrition was being shown. The film was produced by
Hollywood films and filmed in Mayberry, Maryland at the Superfresh Supermarket
with Superfresh’s consent.
Halfway through the film, John and his classmates recognized John shopping at
Superfresh. At the time the film was produced, John was nine years old and extremely
obese. Since that time, he had undergone psychiatric counseling which had
successfully reduced his food intake and his weight so that he was now a good athlete,
well-liked by his classmates, and 120 pounds lighter.
The film depicted John in his obese condition eating a banana in the store. The film’s
narrator stated: “Some people are so obese they make monkeys of themselves,” as the
camera zoomed in for a close-up of John. It was apparent that John did not know that
he was being filmed and, in fact, neither he nor his parents had been informed about
the filming.
John’s classmates burst into laughter and began making monkey gestures. John
became the butt of many jokes for weeks on end. As a result, John developed
headaches and nightmares and he had to seek further psychological counseling.
Directions: Use your textbook, Maryland statutes, and the information discussed in
class, answer the following questions:
1. What, if any, tort claims can John bring? Please fully explain John’s chances of
success on each claim. Be sure to thoroughly explain the claim and requisite
elements.
PART 2:
Module Six-Torts
Vanessa Bryant filed an invasion of privacy suit against the Los Angeles fire department and
sheriff’s department for taking photographs at her husband’s fatal crash scene, which included
images of her late husband’s remains, and widely circulating them without her family’s consent.
Given what you have read about invasion of privacy, if you sat on the jury do you believe she
has a cause of action? Please explain your response.

PART 3:
Ethical Dilemmas Questions
Read and answer the following questions:
1. The practice of law considers the “Must, Can and Should” of ethical dilemmas.
According to the Maryland Rules, attorneys can disclose, but the dilemma occurs when
deciding should you disclose. Using the recent Highland Park, Illinois mass shooting as
an example, how would you reconcile your legal, ethical and moral obligation if the
shooter told you a week before the killing that they planned to commit such a heinous
crime? What does the law allow you to do?
2. Which of the following acts by a paralegal would be permissible and which prohibited
under the definitions of legal advice given in this chapter?
 Interviewing a client to obtain the facts relating to an automobile accident
 Telling the client that the firm probably would be able to get a $10,000.00
recovery
 Explaining to the client what happens at a deposition.
 Attending a deposition without a lawyer present
 Telling a client that the best course of action would be to file a small claims action
 Answering a client’s questions about the meaning of terms in a contract

Capstone Discussion Journal

Discussion Forum – Capstone Journal:
Each student must respond to a discussion forum question asking the student to detail in a minimum of 750 words how the student successfully accomplished each of the below 4 program goals through the course work and learning experiences in the Public Safety Administration Program.
List each program goal and write your response under it.
Response Posting Requirement – You must respond to 2 of your colleagues postings with a reaction to their experiences in the public safety administration program. Response posting to colleagues must be a minimum of 100 words.
It is worth a maximum of 340 points.
Public Safety Administration Program Goals:
Upon completion of the Public Safety Administration Program, students will have demonstrated the acquisition of the ability:
To apply appropriate strategies to manage, supervise, and lead public safety administration departments and staff.
To accurately evaluate response methods related to rapidly changing environments and communities.
To summarize ethical and legal decision making processes in public safety administration using higher order critical thinking skills.
To investigate effective communication and problem solving practices for application to various public safety administration scenarios.
Your posting may also include self-reflections of how skills were demonstrated in a practical setting. For example, communication skills that were learned in xxx course were used in the application of writing a new fire fighting procedure manual which links to program goal #4.
The student must articulate evidence of reaching each program goal. Your posting needs to be detailed, comprehensive and clearly written.
The format for the Capstone Journal Discussion Forum Posting will be to list each program goal. Then under each of the program goals provide written evidence of how the program goal was accomplished. For example:
Example of Capstone Journal posting for Program Goal #1:
Program Goal # 1 –
Upon Completion of the Public Safety Administration Program, students will have demonstrated the acquisition of the ability to – Apply appropriate strategies to manage, supervise, and lead public safety administration departments and staff.
My Evidence
The Public Safety Administration Program at St. Petersburg College has prepared me to manage, supervise and lead public safety administration departments and staff.
PAD 4046 Managing Conflict in Public Organizations was a class that especially helped me to be a better leader in my organization. I was able to learn new techniques such as the method of cooling down, slowing down and engaging constructively. The class gave me a better understanding of how to deal with difficult people and not react out of emotions when angry. I was able to practice some lessons learned such as listening for understanding and perspective taking. Listening for understanding is really listening closely and putting myself in the other person’s position. I found it to be very effective in dealing with some difficult people I work with. This class also helped me define my management style to become a better supervisor and manager.
PAD 4232 Grant Administration & Resource Development is another class that I learned a great deal in. I learned some excellent skills when it comes to grant writing. The class workbook was easy to follow and had worksheets for each section of the grant proposal. The step by step process of writing a grant proposal was easy to follow and remember. I am confident that I will be able to help obtain a grant for my department when, and if, needed. I wrote a grant proposal for a firearms range for my department. The confidence I’ve obtained in this class will reflect positively on my management style.
PAD 3874 Community Relations Theory and Practice was a class that prepared me to be more aware of the importance of community relations in my organization. A strong relationship with the community is very important. It is also important to have a relationship with the media because the public perception of my department will often be created by the media and their coverage of local events impacting the community. I will take what I’ve learned from this class and use it to build a strong relationship with my community that my department serves and protects. We are very good at maintaining a positive perception and I look forward to expounding on that. The class has also taught me to be a better communicator and a better leader.
