Instructions
In your first of two written assignments this semester, you need to provide a critical reflection of the Thomas Chan case. Begin by reading the MacLeans article Does Thomas Chan belong in prison ? Please note: this article describes events that you may find upsetting.
Your critical reflection needs to include the following sections and address these questions.
Section A: Summary (500 words) summarize the key themes discussed in the MacLeans article. What are McLarens (the author of the article) central arguments?
Section B: Reflection and Analysis (500 -750 words total) this section of your assignment needs to answer the following questions:
1. Given what you have read in the article, do you think section 33.1 of the Canadian Criminal Code violates someones right to a fair trial?
*section 33.1 suggests a person cannot use the defense of extreme intoxication (automatism) in cases involving violent crime.
2. Compare and contrast how the demonic perspective, the classical school and positivist school would explain Chans actions. What would each perspective or school of thought consider an appropriate sentence for Chan (make sure you make a clear connection to each perspective).
3. Using an evidence-based approach (arguments based on research) what do you think would be an appropriate outcome in the Thomas Chan case? Should Chan be sentenced to jail, a sentence in the community or receive no sentence at all? To what extent, if any, do you think Chans case differs from cases where a person is found NCRMD (not criminally responsible on account of mental disorder).

Summary:
For this assignment, you will write up a formal paper in which you explain how your concepts are refelcted in/applicable to your chosen current event/issue. You will integrate scholarly literature (a minimum of four scholarly sources beyond those readings assigned in class) into the development of a cohesive, well-reasoned argument to make your case. [You should use at least two scholarly sources for each concept]. Although you are welcome to use your textbook and other class readings in your paper, these will not be counted toward the four-source minimum requirement.
The essay must include a title page and reference page. The body of the paper should be 5-7 pages in length (i.e., page count excludes title page and reference page). The argument should be well structured and well supported. The paper should be well organized (intro, body, conclusion) and well written.
