Facts: A (husband) and B (wife) get into a fierce argument. During the argument, A forcefully grabs B’s arm and twice violently slaps B in the face. B calls the police, reports the incident and A is arrested.
Assignment: Discuss the extent, if any, to which the primary justifications for criminal punishment support the prosecution of A for domestic violence, if B is insistent and clearly communicates to the District Attorney that she genuinely does not want B criminally prosecuted.
Instructions: Your essay should be three-to-four pages, double-spaced with one-inch margins. Support your points and arguments with page specific citations to assigned readings from Law 101 and, if you identify relevant materials, An Introduction to the Sociology of Law. Avoid outside sources. As shared before, 2-1/2 or 2-3/4’s pages do not equal three. Also, please avoid use of the first-person voice, e.g., “I think,” “I believe,” “in my opinion,” etc. It is understood the views expressed are your own.
*Please use one source from LAW 101 and one source from An Introduction to the Sociology of Law.*
