This assignment is worth 50 points. Use the attached Rubric as a checklist to ensure successful completion of the assignment.
Deliverables
Prepare a simple Will for yourself which will be due by February 16, 2020. Please submit in a Word document. If you have any questions, please let me know.
Students will use online Lexis-Advance to research related templates, cases, and statutory law.
Assignment Students will submit a simple Will for themselves which will comply with their state laws and will be evaluated using a rubric:
Exemplary:
The Will must contain the name & address of the testator.
The Will must cancel all previous wills & codicils of the testator.
The Will must contain the marital status of the testator.
The Will must provide statutory inheritance to the spouse of the testator.
The Will must name an executor.
The Will must distribute all of the testator’s personal property.
The Will must distribute all of the testator’s real property.
The Will must name a guardian for the testator’s minor children.
The Will must provide for payment of the testator’s debts.
The will must provide for payment of estate taxes if any.
The Will must have a no-contest close.
The Will must provide for the testator’s burial manner & costs.
The Will must have a residuary paragraph to take care of the un-named property of the testator
The Will must be dated.
The Will must be signed by testators.
The execution of the Will must be witnessed by at least two adult witnesses.
Acceptable: If items # 9, 10, &/or 11 stated above are missing.
Unacceptable: If items # 1, 2, 3, 4, 5, 6, 7, 8,12, 13, 14, 15, &/or 16 are missing.
Desired Expectation: 70% or more at the Exemplary level
