INTRODUCTION: In the Legal Traditions chapter on civil law, Glenn covers quite a bit of intellectual territory. Especially interesting for our peacemaking purposes are his discussions about the assumptions of legal rationality and the goal of law (p. 152), the objectivization of law (p. 158), interactions amongst traditions (p. 164 and beyond), and identities (p. 170). In this paper, you’ll delve into these ideas and connect them with your own peacemaking practice by formulating strategies and tactics for respecting identities and utilizing the example of diversity engagement.

Glenn observes that civil law’s rationality is created based on classical logic. While classical logic lets you build things such as pyramids, temples, and legal codes, it does seem to lack in the tolerance found in other traditions, such as the Talmudic tradition’s “these and these” (p. 153). He says there are other ways of thinking about it besides classical logic. In your opinion, how does our culture’s thinking about objectivity, logic, and facts color our understanding of dispute resolution? Glenn notes that Roman law co-existed with canon law (sometimes taught together in a single text – see the Brundage reading for more on canon law) and the various laws of places under Rome’s control. Moving forward in history, he looks at how Europeans have viewed unifying, and now harmonizing, continental law (pp. 167-168). After reading about this tolerance within the civil system (see also, cthonic, Hindu, and Talmudic traditions), what lessons of tolerance and co-existence can you take into your own peacemaking practice? Identity is relevant both in legal traditions and in conflict (we have a whole course on it, after all). In our text, it’s mentioned that Europeans hold several identities, but that they’ll “defend any of them against external challenge” (p. 170). The book also discusses an increase in localization (a revolution itself). In the course creator’s opinion, intellectual and social localization are some of the driving factors in contemporary social conflicts.
