Mass Incarceration – Abolitionist Perspective

ASSIGNMENT

You will play
the role of a Black Lives Matter transgender abolitionist leader born in the
year 2000 who grew up in Bedford-Stuyvesant (Brooklyn) in the midst of
gentrification.
Bear in mind
that being an abolitionist does not mean to argue for an end of punishment. It
does not mean anybody can do anything and walk away with it. It means that you
believe (1) that the end of slavery is an ongoing, not a finished, process
(many still experience its many legacies) and, (2) that incarceration preserves
the racial hierarchies and ideologies emerged during slavery. It also means
sustaining that the purpose of the penal system is not so much to protect
society from dangerous criminals but rather, to control impoverished racial minorities.
In other
words, what needs to be abolished is not punishment but the social function of imprisonment
as a control system targeting specific racial groups and social classes. If the
prison system really focused on dangerous criminals, it would be visibly
reduced (probably to something like 5% of its current size). Most importantly,
the prison population would no longer respond so strongly to such a specific
racial and class profile.

Your report
will be read in the National Congress, in the context of a debate on criminal
justice reform. Your dream is a world free of racism with equal opportunities
to all. Those who defend the prison system know you are a BLM community
activist and will use that information to disqualify you: your arguments should
be convincing not only for people who think like you but also for those who do
not think like you.

Your report will have a total of 500 words, excluding citations and titles. The format will be similar to the discussion forums (ASA style, introduction, conclusion, etc.)
In the introduction (1 paragraph) you will explain what you will be talking about and mention what kind of sources you will be using to support your findings. Define key terms (such as “mass incarceration”). Provide an outline of what you will discuss, and briefly mention your major argument.
The main body (discussion – 3 paragraphs) will be a presentation and critical interpretation of your major findings. Findings will include at least 3 statistics. Use the qualitative sources to elaborate arguments. Use this section to anticipate counter-arguments.
To conclude (1 paragraph), offer two recommendations of reforms towards de-carceration. You can guide yourself using the question that opens the last chapter of Angela Davis’ book Are Prisons Obsolete?

Termination of Agency and Relevant Remedies

Assignment
Topic
Alpha GmbH (“Alpha”) is a successful
German green electricity and gas company who decided in June 2019 to enter the
British market. Its most senior management agreed on the following business
model for the UK: Alpha’s employees should focus on the supply of energy while
sales (to both individual and corporate customers) should be delegated to
agents. Thus, Alpha concluded between January and April 2020 indefinite term
agency agreements with around a dozen individuals as well as a company, Epsilon
Ltd. (“Epsilon”). Epsilon advertises itself as the high quality but low-cost
solution on the commercial agency market. It employs only two directors. Their
main task is to conclude, on behalf of Epsilon, agency agreements with
individuals with strong sale experience in the specific market considered by
their client, i.e. electricity and gas in the case of Alpha. In consideration
of their sale experience, Epsilon pays its agents a higher than average
commission (with an upper limit of 30% of Epsilon’s own commission from Alpha).
Epsilon concludes with its agents automatically renewable non-exclusive fixed
term (four months) agreements subject to Chinese law. The latter states that
any commercial agency agreement may be terminated at any time without any
compensation or indemnity and that this rule cannot be derogated from by the
parties in their contract. Thanks to its past and on-going experience in the
energy sector, Epsilon has been able to hire around 200 experienced agents to
market Alpha’s products.

Part
1 (2,250 words):
In September 2020, Alpha learnt that
it was unfortunately under investigation by the UK Regulator for mis-selling.
The Regulator has indeed received numerous complaints from consumers, in
particular vulnerable consumers who claim to have received misleading
information. After an internal investigation, Alpha believes that the problem
lies with three agents in particular, who were recently hired and are still on
a trial period of six months. Alpha therefore decides to let go these agents
with immediate effect. To be on the safe side, and avoid further potential
mis-selling issues due to the lack of experience, Alpha has also decided to let
go all other agents on a trial period. It has therefore given a one-week notice
to two other agents, as per the agency agreement. At the same time, Alpha took
this opportunity to get rid of two agents who have been performing very badly,
bringing only one sale per week on average in the last seven months. Their
contracts were immediately terminated. One agent also spontaneously ended last
week his agreement with Alpha as he has contracted COVID-19. In all the above
cases, Alpha has not provided any termination payment, relying in particular on
the explicit exclusion in the agency agreement of any termination payment while
on trial period or the breach of the agency agreement for poor performance.

Please advise Alpha on its legal
position under the Commercial Agents (Council Directive) Regulations 1993.

Part
2 (2,250 words):

Yesterday, Alpha received a letter
from the UK Regulator stating that it was forced, with regret, to hand Alpha
with a 2.4 million pounds fine for continuous and significant breach of its
licence to supply energy. Furthermore, Alpha is prohibited from selling
electricity and gas in the UK for the next five years. All 78934 existing
customers will be moved to another energy supplier within the next 30 days. The
Regulator’s decision is effective as of tomorrow. As a consequence, Alpha is
currently texting or phoning all its remaining agents for the UK market, as
well as those hired by Epsilon, stating that their agreements will be
terminated starting tomorrow and that unfortunately no termination payment will
be made given the exceptional circumstances the company finds itself in.
Moreover, Alpha reserves itself the right to claim back from its agents and
those hired by Epsilon the 2.4 million pounds fine: at the end of the day, they
were solely responsible for the sales, were not they?

Please advise Alpha on its legal
position under the Commercial Agents (Council Directive) Regulations 1993.

Transnational English and culture

READ ALL INSTRUCTIONS CAREFULLY!!!! PDF DETAILED INSTRUCTIONS INCULDED, SOURCE INCLUDED.

The goal of the class is: Examination of texts written in English that de-center the nation-state as the central way to organize cultural comparison; includes colonialism, economics, empire, globalization, migration, race and refugees. What is the transnational turn in literary studies? What makes a text transnational? This class will examinethe relationships among issues such as colonialism andimperialism with categories of identity such as race, gender, and nationality. In exploring these relationships, this class asks, how do certain approaches or frameworks affect our understanding of texts? SO keep this in mind in writing the paper.

Discuss the following statement with reference and relevance to specific literary works: the Puritans were typological (remember your notes from the Puritan unit), the eighteenth-century writers were logical, but the early-nineteenth-century writers were analogical in their way of knowing and expressing what it means to be an American. What does this mean and how do we see it in the literature?

1. The essential difference between the writers of Puritan New England and those of the American Enlightenment is that the former believed that man was irrational and basically corrupt and the latter believed man rational and basically good.” Discuss. In your discussion, consider the works that you have read. How do we see these ideas reflected in the works of each period?
2. Americans are very proud to say that this country was founded on Christian principles. What’s interesting, however, is that many of the thinkers of the time of the formation of this United States as we know it were Deist, not Christian. In what five ways is Deism different from religions like Christianity, Hinduism, Judaism, or Islam?

Telemedicine Discussion Review

Latifi, R. (Ed.). (2011), Telemedicine for trauma, emergencies, and disaster. Norwood, MA: Artech House

Approaches To Social Research discussion

For this graded discussion you have two tasks:
Based on your assigned reading for this week, describe an unethical study that could have been prevented by the existence of an IRB. (CITE THE PAGE NUMBER FROM THE TEXT). In your opinion, did this study produce important knowledge, even if it was unethical? What other (ethical) ways might this knowledge be found?
Read through your classmates’ answers to this question, and post a substantive response to at least one post. Examples of how to respond include asking for clarification on particular points, providing additional information that contributes to your classmate’s overall argument, and providing information that may challenge your classmate to expand their argument.

Creating Rock and Roll Sound

Rock and Roll is often understood as a formula R&B + C&W = R&R
Why is this explanation of the music inadequate? Discuss some of the other factors that contributed to the diversity of rock and roll, beyond the mixing of R&B and country music.

Social Media and Conscious Marketing Options Menu: Forum

Part A
Most major companies use social media to interact with their customers. One famous example of this is the Wendy’s Twitter account which uses both humor and speedy responses to engage with customers. Here is an example of Wendy’s responding to a customer quickly who had a concern about their food. Here is an example of Wendy’s using humor to engage with its customers. On page 80 of your textbook, the “4E Framework for Digital Marketing” is explained: Excite customers with relevant offers, Educate them about the offering, help them Experience products, give them the opportunity to Engage with the firm’s digital marketing activities. While Wendy’s does share offers on it’s Twitter, the tweets I listed are examples of the company Engaging with customers. The book lists examples about how each of the four E’s are used by companies.
For this question: I would like you to:
1. Select a company
2. Analyze their social media
3. Select a post or two of theirs and explain which E they are implementing and why.
