The essential question is whether the Court should ever recognize positive rights, like the right to public education, as fundamental rights under the U.S. Constitution? Positive rights under the U.S. Constitution can best be explained as rights that provide citizens of the country with tools, they may use to secure their health and well-being. Without a doubt, the Supreme Court should recognize positive rights, like the right to public education, as a fundamental right under the U.S. Constitution. Part I of this article will summarize three articles involving the right to education. Part II will discuss the role and policy analysis of the Court’s interpretation of the right to education. Finally, part III will discuss the legal theory behind the Court’s interpretation.
